Customer Remedy

 

Company’s entire liability, and your exclusive remedy, shall be a refund of the purchase price paid or repair or replacement of the purchased item, at the sole discretion of the Company.  Any claims for remedy must take place within thirty (30) days of date of purchase.  Company’s liabilities and your remedies are limited to the United States of America and its territories.  Company shall retain the right to extend its liability to other countries at its sole discretion but is not obligated to do so.  Refunds are limited to purchase price only.  Any shipping or handling costs are the sole responsibility of purchaser. All deposits for services are strictly non-refundable deposits.

Some States do not allow exclusions or limitations of liability so the above may not apply to you.  Check with your State for laws pertaining to your situation.

 

Limitation and Exclusion of Liability

 

COMPANY, OWNERS, MEMBERS, PARTNERS, OFFICIALS, AFFILIATES, EMPLOYEES, CONTRACTORS, SUBCONTRACTORS OR OTHERWISE, will not be liable for any damages whatsoever, including without limitation, incidental or consequential damages resulting in, caused by or arising from loss of business profits, business interruption, loss of business information or personal information or loss of business or personal property either proprietary or otherwise.

Performance and Jurisdiction

 

This agreement is a contract between Company and you.  Company is located in the State of New Hampshire, in the County of Carroll, in the Town of Moultonborough USA.  By accepting the terms of this agreement you agree that this contract is entered into in the State of New Hampshire, the County of Carroll, and so shall be enforceable and governed.  You agree to be bound by the laws of the State of New Hampshire.  By participating in this agreement you are agreeing to be bound by contract.

 

This agreement shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of laws and rules.  Any legal action arising out this agreement shall be litigated and enforced under the laws of the State of New Hampshire.  In addition you agree to submit to the jurisdiction of the Courts of the State of New Hampshire. And that any action pursued by you shall be within the exclusive jurisdiction of the Courts of the County of Carroll and the State of New Hampshire, USA.

 

This agreement may have been entered into by electronic means or otherwise.  You agree that by using web sites, products or services that are offered by Company, constitutes acceptance of this agreement and agree to be held fully responsible for understanding this agreement.  You agree that you have been given the opportunity to receive a printed copy of this exact agreement for your records and that whether or not you chose to receive the printed copy you agree that you in fact have been given a printed copy and have in fact reviewed this agreement in full and agree to its terms.  You agree that you have the right to not accept the terms of this agreement and that your use of Company’s web sites, products or services is not being forced and is at will because you in fact do agree to the terms herein.  You agree to check regularly with Company for the purpose of understanding any changes in these terms that may effect your future acceptance of this agreement. 

 

Copyrights, Trademarks, Service Marks and Proprietary and Intellectual Properties.

 

You may be exposed to web sites, products, services and/or Proprietary and Intellectual Property that is protected by Copyrights, Trademarks, Service Marks, Patents, Patent Pending or other legal or non-legal claim.  You agree not to violate the rights of COMPANY, OWNERS, MEMBERS, PARTNERS, OFFICIALS, AFFILIATES, EMPLOYEES, CONTRACTORS, SUBCONTRACTORS OR OTHERWISE.  You may not alter, copy, print, modify, publish, transmit, participate in the transfer or sale of, create derivatives of, or in any way exploit, in whole or in part, any part of any web site, product or service offered by or owned by COMPANY or any of its OWNERS, MEMBERS, PARTNERS, OFFICIALS, AFFILIATES, EMPLOYEES, CONTRACTORS, SUBCONTRACTORS OR OTHERWISE.

 

Company has not issued you any type of license unless it was in writing and Company holds an original signed copy at its corporate office located in Moultonborough, NH.

 

All images, text, contents, products, services, tools, programs, scripts, or any other intellectual or proprietary property may be licensed for use but are never sold, unless otherwise stated in writing.  Reproduction of any kind is prohibited.  You may not use, copy, alter, emulate, clone, modify, decompile, disassemble, transfer, reverse engineer, clone, rent, lease, sell, license, sublicense, sublet, transfer license of or otherwise any images, text, contents, products, services, tools, programs, scripts, or any other intellectual or proprietary property without the express written consent of Company.  Any such unauthorized action or use shall result in immediate and automatic termination of any license issued to you by Company and may result in criminal prosecution and/or civil penalties.

 

Company reserves all rights not expressed in this agreement.
